Während der Zeit im Mutterleib oder in der Zeit kurz nach der Geburt ist ein gesundheitlicher Schaden entstanden.

Ein gesundheitlicher Schaden des Kindes kann entstehen, wenn bei der Mutter gesundheitliche Probleme bestehen. Beispielsweise können sich bestimmte Erkrankungen der Mutter darauf auswirken, wie sich das Kind im Mutterleib entwickelt. Während der Schwangerschaft und Geburt können zum Beispiel Krankheits-Erreger von der Mutter auf das Kind übertragen werden. Auch medizinische Maßnahmen bei der Mutter können zu einem gesundheitlichen Schaden beim Kind führen.
